In Florida, constructive possession means that even though a person did not have contraband on them, the item was within their control… for example, a person driving their own car is found with marijuana or ecstasy in the center console… even though several defenses exist, the state can validly charge that this person constructively possessed the drugs.
These cases often have good chances of being won at trial because the State’s burden is rather overwhelming.
